is pretty big, about 30 feet across and you can actually put your hand underneath the median there and it will come out on the other side. it is -- it has forced crews to shut down one lane of highway 87 southbound in the alma avenue on-ramp. caltrans discovered the problem tuesday, they came out, they poured some gravel and then last night they compressed that gravel and found that it sunk about a foot below the earth's surface and you can see where that concrete is exposed, all the cracks there. so they shut down some lanes on the freeway at 9:00 last night. we are close to west virginia street just to give you an idea of where we are on 87, and again one southbound lane is closed as is the alma avenue off-ramp. but the on-ramp from 280 is open and crews are expected to be out here all morning repairing the sinkhole so you definitely want to avoid this area. we would suggest using south alma avenue to -- expressway to 87 or also take monterey road as well and cut across to west capitol expressway to 87th. live in san jose, i'm tara moriarty, ktvu channel 2 news. >>> we want to go

>>> welcome back. i'montessa brewer back in the saddle covering the big news coast to coast. we begin with breaking news. the judge in the roger clemens perjury trial has just declared a mistrial. nbc's pete williams is in washington, d.c. what's the judge saying about this trial, pete? >> reporter: well, the judge has said he'll decide at a hearing on september 2nd, almost two months from now, where we go from here. this trial had just started yesterday with opening statements from both sides and the prosecutors had begun calling witnesses, but the judge had told the prosecutors in advance that certain evidence was off-limits and one of the things that was off-limits was related to testimony by a friend and former teammate of roger clemens named andy pettitte who had played with him on two major league teams. andy pettitte has said that roger clemens told him he used human growth hormone. clemens says that pettitte is mistaken. what's at issue here is a legal document, sort of sworn statement by the wife of andy pettitte, who says yeah, i heard my husband tell me that roger tol

discretionary military spending, we have mandatory domestic and then we have these big entitlement programs. i would like a review on those kinds of cuts as it relates to your caution about shark cuts in the short term. >> there is already a good bit of fiscal contraction going on in the sense that there was a spending.up in the states and localities have done under continuous pressure because of limitations on their budgets, which has led them to be cutting. we have experienced a good deal of fiscal tightening. there are some headwinds in the economy. i cannot pick and choose among programs. you want to think about the desirability of these programs under their own merits. i want to be clear that cutting programs or raising taxes in ways that will reduce demand and spending and the ability of consumers to meet their bills and to purchase goods and services is going to slow the economy. that will offset some of the benefits of the cuts. it will reduce revenues and make the deficit worse in the short term. >> let me suggest an approach. it showed entitlement program spending that cr
